Donald Trump’s legal team has filed a series of motions aiming to dismiss the racketeering charges against him in Georgia.
They argue that the indictment violates due process, targets political speech, and goes against historical precedent.
Additionally, they claim presidential immunity from prosecution for acts during his presidency and assert protection from double jeopardy due to his Senate acquittal. (Trending: Epstein’s Brother Finally Breaks His Silence)
Trump’s attorneys wrote, “the alleged criminal conduct underlying this indictment consists entirely of core political speech at the zenith of First Amendment protections.”
“As a result, President Trump did not have fair warning that his alleged conduct, pure political speech and expressive conduct challenging an election, could be criminalized, particularly since such actions have never before been prosecuted and no President has ever been criminally charged in the 234-year history of the United States of America,” continued Trump’s filing.
“While the statutes underlying this indictment have been in existence for many years, the novel construction the State seeks to now employ violates all notions of due process, particularly since the indictment directly targets pure political speech,” argued Trump’s attorneys.
“President Trump has filed three persuasive, meritorious pretrial motions seeking a complete dismissal of the indictment and thus an end to the Fulton County District Attorney’s politically-based prosecution, in a statement,” wrote Trump attorney Steve Sadow.
The case involves 13 state felony counts, and while some co-defendants have pleaded guilty, Trump and others have pleaded not guilty.
The trial date has not yet been scheduled.
