Jack Smith Wants Trump Gag Order Reinstated in Election Case

Special counsel Jack Smith is seeking to uphold a gag order in Donald Trump’s 2020 election case, citing Trump’s public criticism of the prosecutor as a primary reason to maintain it.

The order, imposed by Judge Tanya Chutkan, had barred Trump from making public statements critical of prosecutors, court staff, and potential witnesses.

“In particular, the Order leaves the defendant free to do virtually everything that he has claimed, throughout the litigation, that he must be able to do to run for office while defending himself in court,” the prosecutors stated. (Trending: Photos Released Of Cocaine Found In White House)

“And the distinctions it draws between criticizing the policies of a political rival or describing the prosecution as politically motivated, on the one hand, and targeting trial participants or their expected trial testimony, on the other, is readily comprehensible. The Order should be affirmed.”

Federal prosecutors argue that Trump’s social media comments necessitate the need for the gag order to be re-imposed, claiming he has threatened witnesses and made prejudicial comments about the case.

The D.C. Court of Appeals lifted the gag order temporarily and is scheduled to hear oral arguments on the matter.

Trump’s legal team contends that the order is too vague and unconstitutional, and they are prepared to go to the U.S. Supreme Court if necessary.

Additionally, Trump faces criminal charges in Georgia, New York, and Florida, and has pleaded not guilty to all charges.
