During his address about the classified documents investigation, President Biden claimed Special Counsel Robert Hur questioned him about the timing of his son Beau’s death, but NBC News sources say this is false.

Hur did not ask about Beau’s death – it was Biden who brought it up himself during the interview while discussing a period when he worked with a ghostwriter on a memoir about Beau’s passing.

“There’s even a reference that I don’t remember when my son died. How in the hell dare he raise that?” Biden said. “Frankly, when I was asked the question, I thought to myself, ‘It wasn’t any of their d— business.’”

When attempting to recall the timeline, Biden appeared confused about the year Beau died, though stated the correct date.

The report did not establish Biden’s guilt beyond reasonable doubt but did find he willfully retained classified materials as a private citizen.

The investigation “uncovered evidence that President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen,” the report noted.

Biden’s memory also factored into the decision not to pursue charges, as prosecutors thought a jury may find reasonable doubt for an elderly former president with a poor memory.

“It would be difficult to convince a jury that they should convict him — by then a former president well into his eighties — of a serious felony that requires a mental state of willfulness,” the report stated.
