A woman in Grapevine, Texas has been charged with murder under a new state law for her alleged role in her boyfriend’s fatal drug overdose.
Kami Ludwig was arrested after police say she purchased fentanyl-laced pills, cocaine, and other drugs from dealers in Fort Worth and Louisiana, then brought them to her boyfriend William Shane Nolen.
Nolen died of a fentanyl overdose at their home while his young son was present.
The new law allows for murder charges against those who supply drugs in overdose deaths.
While some question if the law was intended for drug users rather than dealers, police found evidence Ludwig actively sought out and transported the drugs to Nolen.
The Grapevine Police Department said, “They found evidence that she sought out the pills.”
“She bought them and brought them back to the victim. He took them, and he died,” the police continued.
Criminal defense attorney, Zachary Ferguson, said, “I think that it will be a difficult case for the state to prove.”
“From my understanding of the facts of this case, I don’t think that was the intent of the bill,” he continued.
“When the bill was passed, I don’t think it was intended to pursue individuals who are drug users,” explained Ferguson.
Her attorney maintains judgment should be reserved until facts are known, and Ludwig also grieves the loss of her friend. Police continue investigating the drug dealers involved.
Ludwig’s attorney wrote in a statement, “Fentanyl murder is a serious accusation, and judgment should be withheld until all the facts and circumstances are known. We proudly defend Kami as she, too, struggles with the loss of a beloved friend.”
