The Biden administration has asked the U.S. Supreme Court to overturn a lower-court ruling that prevents it from regulating “ghost guns,” which are privately made firearms that are difficult for law enforcement to trace.

The Department of Justice argued that the ruling wrongly declared a rule adopted by the Bureau of Alcohol, Tobacco, Firearms, and Explosives in 2022 as “unlawful.”

The rule aimed to address the rise of ghost guns, which can be assembled from kits without background checks and lack serial numbers.

The administration warned that allowing anyone to buy a kit online and assemble a functional gun without checks or serial numbers could lead to untraceable ghost guns flooding communities and endangering the public, hampering law enforcement efforts to solve violent crimes.

“The result would be a flood of untraceable ghost guns into our nation’s communities, endangering the public and thwarting law-enforcement efforts to solve violent crimes,” the Justice Department said.
