Democratic presidential candidate U.S. Rep. Dean Phillips filed a lawsuit after being left off Wisconsin’s primary ballot, seeking to be added.

However, the state elections commission and a bipartisan panel argued that his lawsuit was filed too late, as he waited until the last minute to take action.

They emphasized that the ballots needed to be prepared and mailed on time, and that Phillips had the option to gather signatures to get on the ballot, which he didn’t pursue.

“Phillips did nothing until the eleventh hour,” they said.

“As we fight Trump’s attacks on democracy we must also be vigilant against efforts by people in our own Party to do the same,” Phillips said.

Phillips, challenging Biden, claimed his request was unlawfully ignored, citing Wisconsin law, and criticized the process as favoring Biden.

“Voters should choose the nominee of our Party without insiders trying to rig the process for Joe Biden,” Phillips said.

Biden won the New Hampshire primary as a write-in candidate, while Phillips received about 20% of the vote.
