A group of 25 U.S. history scholars filed an amicus brief supporting Colorado’s stance that the 14th Amendment should bar Donald Trump from running for president.
They argued that the amendment’s insurrectionist clause should prevent Trump’s candidacy, citing historical evidence and originalist interpretation.
Colorado and Maine have successfully disqualified Trump, prompting appeals to the Supreme Court.
“For historians, contemporary evidence from the decision-makers who sponsored, backed, and voted for the 14th Amendment is most probative,” the historians wrote.
The case is expedited, with a hearing scheduled for February 8, and a decision expected before Colorado’s primary on March 5.
The scholars’ argument focuses on the historical understanding of the 14th Amendment and its implications for presidential eligibility based on Trump’s actions following the 2020 election.
