Special Counsel Jack Smith referred to potential witnesses as “political witnesses” in a revealing error in response to the Trump legal team’s appeal of a gag order on the former president.
The gag order, issued by U.S. District Judge Tanya Chutkan, has led to widespread condemnation and accusations of election interference.

“At the hearing that followed, the district court reviewed several of the defendant’s social media posts, which fell into ‘roughly five categories,’” wrote the DOJ’s Jack Smith.
Smith’s statement included comments about Judge Chutkan and various court employees, Smith’s team of attorneys and his team, and a reference to “political witnesses.”
Context suggests that the prosecutor intended to refer to “potential” witnesses, but the gaffe has attracted the attention of those that already suspicious of political targeting.
Many of Trump’s statements that Smith is specifically complaining about are accusations that Trump is being targeted for political reasons.

Meanwhile, former President Trump received a win in New York Attorney General Letitia James’ fraud case, as an appeals court overturned a gag order imposed by Judge Arthur F. Engoron.
