Title IX, established in 1972 as an educational amendment to the Civil Rights Act, prohibited discrimination “on the basis of sex.”
Opportunities
While recognizing the importance of acknowledging sex differences for the safety, privacy, and equal opportunities of females, the original lawmakers understood sex in anatomical terms and did not subscribe to the concept of “gender identity.”
Sex-segregated
The traditional understanding of sex based on biology remains prevalent today, particularly evident in sports where most individuals believe in sex-segregated competitions irrespective of transgender status.
Biden administration
Despite the Biden administration’s attempt to separate the Title IX revision from the sports issue, the inclusion of gender identity in the definition of discrimination based on sex raises questions about its application to sports as well.

In 2021, the Department of Justice intervened in the West Virginia women’s sports dispute, arguing that Title IX does not allow the exclusion of transgender girls from participating in single-sex sports designated for girls, according to May Mailman, the director of the Independent Women’s Law Center (IWLC).
Accessible
The updated Title IX rule specifies that locker rooms and restrooms should be accessible based on gender identity, potentially exposing women and girls to male anatomy in spaces where privacy was previously ensured.

During Betsy DeVos’s tenure as the education secretary under the Trump administration, due-process protections were implemented for individuals accused of sexual misconduct.
Safeguards
However, the new rule under the Biden administration eliminates these safeguards. Under the revised rule, the accused no longer has the right to access the evidence against them, and the definition of “sex-based harassment” has been expanded to potentially include the use of sex-based pronouns, which are considered constitutionally protected speech.
Misgendering
Some institutions, like Stanford University, already penalize “misgendering” and “mispronouncing” as forms of discrimination.
