The gag order was imposed by Justice Juan Mercan, who Trump believes should recuse himself due to a perceived conflict of interest involving his daughter’s work for a firm that supported Biden in 2020.
Trump’s appeal aims to delay Manhattan District Attorney Alvin Bragg’s case against the former president.
The appeal could be decided quickly by an appellate court to either reject or consider Trump’s request to push the case past the 2022 election.
The gag order prevents Trump from publicly commenting on witnesses, lawyers, court staff, and their families in a way that could interfere with the case.
