Donald Trump’s attorneys will argue before a Florida judge to dismiss the federal criminal case against the former president for improperly handling classified documents.
They will contend that the Presidential Records Act prevents such prosecutions by allowing presidents to designate materials as personal records.
Prosecutors reject this interpretation.
The court will also consider arguments that the main statute is unconstitutionally vague as applied to presidents.
Both sides will debate these motions to dismiss the indictment, which accuses Trump of wrongfully retaining national defense information and related obstruction charges after leaving office.
The judge is expected to delay the scheduled May trial date while litigation of these issues proceeds.
