During his 2022 State of the Union address, President Biden criticized the Supreme Court’s decision in Dobbs v. Jackson to overturn Roe v. Wade.
He told the six attending justices that they do not understand women’s political power and that reproductive rights would be on the ballot in future elections.
“With all due respect, justices, women are not without … electoral or political power,” Biden said. “You’re about to realize just how much.”
“Those bragging about overturning Roe v. Wade have no clue about the power of women, but they found out when reproductive freedom was on the ballot and we won in 2022 and we won in 2020 and when we win again in 2024,” he added.
Biden’s remarks drew applause from Democratic lawmakers.
His public rebuke of the Court’s decision mirrored actions by former President Obama, who criticized the Citizens United ruling from the 2010 State of the Union podium.
“With all due deference to separation of powers, last week the Supreme Court reversed a century of law that I believe will open the floodgates for special interests — including foreign corporations — to spend without limit in our elections,” Obama said at the time.
“I don’t think American elections should be bankrolled by America’s most powerful interests, or worse, by foreign entities. They should be decided by the American people. And I’d urge Democrats and Republicans to pass a bill that helps correct some of these problems,” he added.
On that occasion, Justice Alito was seen mouthing disagreement.
While uncommon, Biden and Obama’s criticism of specific rulings from the State of the Union stage aimed to counter decisions they felt the Court got wrong.
