Experts say Jack Smith’s filing to Cannon hints he’s ‘gearing up’

Special counsel Jack Smith’s team filed notices of appearance from two prosecutors, one who specializes in appellate issues.

This move could signal that Smith is preparing to appeal aspects of the case related to former President Trump’s classified documents, as the district judge overseeing the case previously denied some of Smith’s requests and failed to rule on key matters in a recent hearing.

“VanDevender has been handling appellate issues for Smith. Could an appeal be coming?” reporter Alan Feuer wrote.

Legal experts noted the appellate prosecutor has previously argued cases before an appeals court, indicating Smith may be gearing up to appeal a ruling from the lower court.

It remains unclear exactly what Smith would appeal, but his team has previously argued the judge erred in declining to shield witness identities, saying it would cause injustice.

“To folks watching for when and if the Special Counsel’s office will appeal a Cannon order, this could be a sign that they are gearing up for one,” former litigator Lisa Rubin said.

The filing of appellate attorneys suggests Smith’s office is positioning itself for a potential appeal down the line.
