A legal dispute over where a SpaceX lawsuit against the National Labor Relations Board should be heard has recently hit headlines.
SpaceX filed the suit in Texas challenging the NLRB’s structure and proceedings, but the NLRB requested a transfer to California.
A Texas judge approved the transfer, but the 5th Circuit paused it pending appeal.
However, the California court still took up the case.
In response, the 5th Circuit ordered the Texas judge to request sending it back, even though the 5th Circuit has no authority over the California court.
The proper venue could impact the outcome, as courts in Texas are seen as more conservative and likely to limit federal powers, while California courts are viewed as more liberal.
The NLRB also asserted the California court could refuse to return the case if deemed inappropriate.
