Empower Oversight has raised concerns about the ATF’s proposed rule on universal background checks, stating that it violates a law from 1986 and could be unconstitutional.
The proposed rule broadens the definition of being “in the business” of selling firearms, potentially impacting private citizens who sell even a small number of guns.
The group is utilizing the Freedom of Information Act to gather records related to the rule’s development, including communications between the Biden White House and the ATF.
“To the extent such a rule prevents the private sale of firearms, it would also clearly violate the Second Amendment to the United States Constitution, which declares that ‘the right of the people to keep and bear Arms, shall not be infringed,’” the group wrote.
