Oregon’s Ballot Measure 114 (BM 114) on gun control was permanently blocked by a court judgment entered by Harney County Circuit Court Judge Robert Raschio.
The measure was initially blocked just days before it was set to go into effect, and it faced continued litigation in state and federal courts.
On January 9, 2024, the judge declared BM 114 facially unconstitutional and permanently enjoined its enforcement.
“IT IS HEREBY DECLARED that Ballot Measure 114 is facially unconstitutional in all of its applications under Oregon Constitution, Article l, section 27; and IT IS HEREBY ORDERED that Defendants and Defendants’ Agents are permanently enjoined from enforcing all provisions of Ballot Measure 14,” Raschio wrote.
The measure had raised concerns among Oregon police, who worried it would limit them to ten-round magazines and require permits to carry firearms off-duty.
