Conservative retired federal Judge J. Michael Luttig and former Obama-era acting Solicitor General Neil Katyal both believe that Donald Trump’s expected appeal to the U.S. Supreme Court regarding his removal from the Colorado presidential primary ballot will fail.
Luttig praised the Colorado Supreme Court’s decision as a “masterful judicial opinion of constitutional law,” and predicted that the U.S. Supreme Court will uphold it, emphasizing that it’s not a political decision.

“Trump had every opportunity in the Colorado court to present his side of the case,” Katyal said.
“He presented it. He lost.”
“And so, at this point, he’s had, I think, his shot.”
It’s a “solemn moment” and “kind of horrendous we are in this situation,” he said.
