Hunter Biden suffered a setback in his effort to dismiss federal tax charges.
At a hearing, Judge Mark Scarsi rejected arguments from Hunter’s lawyers that the charges were politically motivated or that Hunter had immunity from a prior plea deal.
Biden attorney Abbe Lowell said, “It’s a timeline, but it’s a juicy timeline.”
“There is nothing regular with how this case was initiated and investigated.”
The defense claimed the prosecution, led by special counsel David Weiss, was improperly influenced by Republican pressure, but the judge said there was no evidence linking the charges to politics.
While Hunter’s team argued the case timeline suggested outside influence, the judge focused only on facts and law.
Hunter faces charges related to failing to file tax returns for three years and underreporting income.
Judge Scarsi did not appear swayed by claims the charges were “selective” or “vindictive,” saying he would rule on dismissal next month based solely on the merits of the case.
“We are just looking at the facts and law,” Scarsi said. “All of the aspersions cast off one another just roll off.”
If it proceeds, Hunter could stand trial during the 2024 presidential campaign season, adding political drama.
