The Justice Department is pushing for a sentence ranging from four to 10 months for the woman who took Ashley Biden’s diary in August 2022.
Home confinement
The prosecutors are looking to override earlier suggestions for a six-month home confinement for Aimee Harris by U.S. Attorneys in the Southern District of New York.
Harris admitted
Harris admitted guilt in August 2022 for plotting to move stolen property across state lines.
Key factor
DOJ prosecutors informed District Judge Laura Taylor Swain that Harris’s repeated postponements of her sentencing hearing are a key factor in their request for a stricter punishment.
Abused the administration
“The defendant’s sentence must also account for the manner in which she has abused the administration of justice throughout the pendency of this court proceeding,” said US Attorney Damian Williams in a filing.
Improperly delay
“The defendant has repeatedly and consistently engaged in tactics to improperly delay this proceeding, including by misleading the Court with false information to justify belated and unmerited requests for adjournments, refusing to appear when directed, and failing to comply with court orders to disclose or produce certain information,” the document states.
Complete disregard
“Through this pattern of behavior, the defendant has shown a complete disregard for the Court’s orders and for the orderly administration of this judicial proceeding.”
Harris acquired
After staying at a place where Ashley Biden had lived before, Harris acquired Biden’s diary, cell phone, tax records, and family photos.
Personal entries
She then tried to sell the diary, which the DOJ described as containing “very personal entries,” through a middleman.
Harris was aware
Harris was aware that the diary belonged to a close relative of a former government official who was running for national political office at the time.
Sold
The diary was eventually sold to James O’Keefe at Project Veritas for more than $40,000. While the media platform did not explicitly state that they disclosed the contents of Ashley Biden’s diary, certain entries written by her were eventually made public on the internet.
Incarceration
“A sentence involving no period of incarceration would be wholly insufficient to reflect the gravity of the defendant’s conduct, including her apparent belief that she is above the law and that she need not comply with this Court’s orders,” added DOJ prosecutors.
Maintaining innocence
Despite maintaining her innocence, Harris has entered a plea of not guilty. Her sentencing hearing is scheduled for April 9th.
Further charges
Prosecutors have cautioned Harris, who is currently out on bail, that they will pursue further charges against her if she does not show up for the hearing.
