Former President Trump has requested his upcoming New York trial over hush money payments be delayed pending the Supreme Court’s ruling on whether a sitting president has immunity from prosecution.
Trump claims certain social media posts and actions related to payments made during his presidency in 2018 were official acts protected under immunity.
While judges have previously rejected transferring the case to federal court where immunity could apply, Trump’s lawyers argue the Supreme Court case could impact New York.
The high court will hear arguments in April, a month before jury selection in the New York trial where Trump faces felony charges for falsifying records related to paying Stormy Daniels hush money in 2016.
By delaying the New York trial, Trump aims to benefit from the Supreme Court’s forthcoming decision on the scope of presidential immunity in criminal cases.
