Former acting solicitor general Neal Katyal and former federal prosecutor Andrew Weissmann asserted that Donald Trump may have opened himself up to a third defamation lawsuit from E. Jean Carroll.

This comes after Trump railed against having to post a $92 million bond for his appeal in the $83.3 million damages ruling against him for defaming Carroll.

Trump made derogatory comments about Carroll at a rally, saying the damages were based on “false accusations” from a woman he knew nothing about.

“Ninety-one million based on false accusations made about me by a woman that I knew nothing about,” Trump said.

Katyal said Carroll would be “absolutely within her rights” to sue again, as Trump is essentially writing the lawsuit by continuing to defame her.

“And Jen, there are many days that I wish I was Roberta Kaplan, who is Jean Carroll’s extraordinary lawyer, she’s just so phenomenal as a lawyer. But, boy, today is the day I wish I was, because Donald Trump is basically just writing the third lawsuit that she’s going to file right now,” Katyal said.

They noted Trump already lost a jury trial on whether he defamed Carroll.

“Remember, Trump lost in front of a jury of his peers on this question of whether he had defamed Jean Carroll and now he is doing it again,” he said. “And I’m sure she’s just sitting there scribbling it all down and ready to go.”

Weissmann agreed there could be grounds for more legal action and that Carroll could seek an injunction against Trump.
