House Democrats are working on a plan to disqualify former President Donald Trump from running for a second term following a Supreme Court ruling that he cannot be banned from the ballot in Colorado.
The Supreme Court overturned a ruling by the Colorado Supreme Court that barred Trump from the ballot, citing that states cannot enforce Section 3 of the 14th Amendment against federal officeholders or candidates.
“We conclude that States may disqualify persons holding or attempting to hold state office. But States have no power under the Constitution to enforce Section 3 with respect to federal offices, especially the Presidency,” the court ruled.
They added, “Nothing in the Constitution delegates to the States any power to enforce Section 3 against federal officeholders and candidates.”
“Congress will have to try and act,” Rep. Jamie Raskin said.
”I’m working on it — today,” he said.
Raskin is drafting a bill to enable the use of the 14th Amendment to disqualify individuals from holding federal office, despite acknowledging the challenge due to the GOP’s majority in the House.
“I don’t have a lot of hope that Speaker [Mike] Johnson will allow us to bring enforcement legislation to the floor, but we have to try and do it,” Raskin said.
