The Rhode Island Attorney General and a state senator called for an investigation after an undocumented immigrant accused of molesting a child was released on bail despite an ICE detainer.
In March, a Guatemalan man was arrested in Providence for allegedly molesting a child.
Though ICE lodged a detainer, he was released on $50,000 bail against the AG’s request.
ICE later arrested the man in February.
The AG and senator said the man should not have been released and want a review of why the Department of Corrections ignored the detainer.
“Plainly, that should not have happened and there should be a review by the Department of Corrections and the Department of Public Safety of why it did,” AG Peter Neronha said.
The senator is seeking an oversight hearing and information from the DOC to prevent such releases from happening again, saying she was in disbelief it occurred in Rhode Island.
“I was in total disbelief that this could happen in Rhode Island,” Jessica De La Cruz said. “We can’t allow it to happen again.”
