The Supreme Court declined without comment to hear an appeal from three Republican House members – Tom Massie, Ralph Norman, and Marjorie Taylor Greene – who had part of their pay docked in 2021 for violating Nancy Pelosi’s mask mandate on the House floor during the COVID pandemic.
Lower courts had ruled Pelosi could not be sued over the House’s internal rules.
While House GOP leaders opposed the mask rule, they agreed the case was not about the rule’s wisdom but whether the fines could be contested in court.
The trio argued failing to hear the case could allow retaliation against lawmakers acting on their district’s desires rather than the Speaker’s.
They were disputing a $500 deduction for not wearing masks when voting in May 2021.
