A man from Washington, D.C., is suing for $340 million after his lottery ticket appeared to match the winning numbers online, but the lottery company claims it was a posting error.

The man, John Cheeks, selected numbers with personal significance and believed he had won a life-changing amount.

“I got a little excited, but I didn’t shout, I didn’t scream,” Cheeks said. “I just politely called a friend. I took a picture, as he recommended, and that was it. I went to sleep.”

Despite being told by a lottery dealer that his ticket was worthless, he kept it and sought legal counsel.

“Hey, this ticket is no good,” Cheeks recalled an employee saying. “Just throw it in the trash can.”

“I gave him a stern look. I said, ‘In the trash can?’” Cheeks said.

“Oh yeah, just throw it away. You’re not going to get paid. There’s a trash can right there,” the employee allegedly said.

The lawsuit alleges that a contractor for Powerball’s local vendor posted the wrong numbers online.

“They have said that one of their contractors made a mistake,” attorney Richard Evans said. “I haven’t seen the evidence to support that yet.”

“Even if a mistake was made, the question becomes: What do you do about that?”

The attorney representing Cheeks referenced a similar incident in Iowa where winners were paid due to a reporting error.
