Comer to Probe How IRS Treats Liberal Groups

The House Oversight and Accountability Committee launched an investigation into the IRS for allegedly allowing some liberal nonprofits to engage in political lobbying and advocacy despite their 501(c)(3) tax-exempt status prohibiting such activities.

Committee chairman Rep. James Comer cited one group called One Fair Wage Inc. that advocates for increasing the minimum wage.

Rep. Comer wrote, “Tax exempt status under Section 501(c)(3) of the Internal Revenue Code (IRC) and implementing regulations requires that exempted entities are ‘operated exclusively for religious, charitable, scientific, testing for public safety, literary, or educational’ and related purposes.”

“Despite these limitations on political and lobbying activities by 501(c)(3) designated entities, activist advocacy organizations, such as One Fair Wage, Inc., seem to view their charitable work as indistinguishable from their substantial lobbying pursuits,” he continued.

According to legal documents reviewed by the committee, this group described lobbying as its organizational purpose, which would violate its tax-exempt status.

The investigation aims to determine if the IRS is properly enforcing restrictions on political activities for such nonprofits.

The IRS must comply with the committee’s request for documents by February 28th as part of the probe.
