Former White House attorney Ty Cobb suggested that the case regarding Trump’s claim of presidential immunity might conclude by the week’s end.
He expressed doubt about the Supreme Court taking up Trump’s appeal and criticized the strength of Trump’s court filing.
“This petition for a stay is pretty weak,” Cobb said.
“It’s repetitive of their briefs below,” he said. “The arguments that they presented were not only soundly rejected, but eviscerated both in oral argument and in the opinion. I don’t think the Supreme Court is going to find those arguments compelling in any way.”
An appeals court had previously ruled against Trump’s claim of immunity, emphasizing that former presidents are not above the law.
Trump sought a stay of the decision, aiming to delay the trial until appeals were resolved.
Cobb speculated that the Supreme Court might decline to take up the case or issue a short delay before denying it.
“I personally don’t see them taking this case. Although I do think it’s a possibility they could consider the stay petition as a petition for cert and stay the case for 24 to 48 hours and then deny cert,” Cobb said.
He anticipated the case’s potential conclusion within the week.
“I think this case could be over this week,” he said.
