The Supreme Court ruled 5-4 in favor of allowing federal agents to cut through razor-wire fencing that Texas had put up along the southern border, a major win for the Biden administration.
Justices John Roberts and Amy Coney Barrett sided with the court’s liberal justices, diverging from the other conservatives.
The decision follows the Biden administration’s request to vacate an injunction imposed by the Fifth Circuit Court of Appeals, which had temporarily paused a lower-court ruling allowing the cutting of the razor wire.

The US Justice Department alleged that Texas’ actions were hindering Border Patrol’s ability to patrol and respond to emergencies along the border.
The Justice Department wrote, “That fencing further restricts Border Patrol’s ability to reach the river in particular areas.”
The agency added that Texas’ approach “demonstrate an escalation of the State’s measures to block Border Patrol’s ability to patrol or even to surveil the border and be in a position to respond to emergencies.”
