The Supreme Court declined to hear an appeal from Devon Archer, an associate of Hunter Biden, who was convicted of defrauding a Native American tribe.
Despite arguments from Archer’s lawyers about legal questions and sentencing guidelines, the court’s decision means he will likely have to serve his one-year prison sentence and pay substantial restitution.
Archer’s lawyers argued that the Supreme Court must first decide if “district courts [have] discretion to reweigh the evidence when evaluating a new trial motion, as eleven other federal courts of appeals have held to varying degrees, or whether the rule requires a district court to defer to the verdict unless there is some concern beyond the weight of the evidence, as the Second Circuit held in this case,” before they proceed.
