E. Jean Carroll’s second defamation trial against Donald Trump is commencing.

The first case, “Carroll I,” was delayed but has now survived and is ready for trial.

The presiding judge’s ruling in a separate defamation case, “Carroll II,” has essentially predetermined Trump’s liability in “Carroll I.”

The only decision left for the jury is the amount of damages Trump must pay Carroll.

Legal theory “collateral estoppel” prevents Trump from re-litigating issues already decided by a jury.

Trump’s attempts to limit Carroll’s damages have been denied.

Judge Kaplan wrote, “the jury considered and decided issues that are common to both cases.”

His ongoing defamatory actions and potential testimony in his defense could further complicate his situation.

The trial is expected to proceed without room for dramatics, potentially resulting in a substantial verdict against Trump.
