Congressional Republicans, including Senate Minority Leader Mitch McConnell, have supported a Supreme Court brief urging the court to side with former President Donald Trump on his eligibility to appear on Colorado’s ballot in the 2024 election.

This comes after a Colorado court barred Trump from the state’s Republican primary ballot due to his role in the January 6, 2021, attacks on the U.S. Capitol.

The Colorado Supreme Court found Trump ineligible based on Section 3 of the 14th Amendment, which bars public officials who engaged in insurrection or rebellion.

Prominent GOP lawmakers organized the brief, urging the justices to overturn the Colorado ruling.

Notably, three Senate Republicans did not endorse the Supreme Court filing, including Susan Collins, Lisa Murkowski, and Mitt Romney.

Despite publicly blaming Trump for lying about the 2020 election and causing insurrectionist violence, McConnell still signed onto the brief.

David Graham previously wrote, “This embrace of the president’s attempt to overturn the results of the election is both shocking and horrifying. … Republican officials have gone from coddling a sore loser to effectively abandoning democracy.”

It remains uncertain whether congressional Democrats will present a competing legal brief to the justices.
