The development comes after the Texas National Guard seized Shelby Park in Eagle Pass, preventing Border Patrol from entering.

Governor Abbott has asserted the state’s legal authority to control entry to locations within Texas, including the park in Eagle Pass.
“That authority is being asserted with regard to that park in Eagle Pass, Texas, to maintain operational control of it,” Abbott said.
The Texas National Guard has been implementing temporary barriers to deter illegal crossings.
The Biden administration has sought Supreme Court intervention to allow Border Patrol agents to remove the fencing, but a ruling is pending.
