A federal judge has cleared the way for the execution of a death row inmate in Alabama using nitrogen gas, despite objections that the method is untested and inhumane.
The inmate, Kenneth Smith, was convicted of a 1988 murder-for-hire plot and survived a botched attempt at lethal injection last year.
“I was strapped down, couldn’t catch my breath,” Smith recalled.
“I was shaking like a leaf. I was absolutely alone in a room full of people, and not one of them tried to help me at all, and I was crying out for help.”
His attorneys are expected to appeal the decision, with the case potentially reaching the U.S. Supreme Court before his scheduled Jan. 25 execution date.
Smith has expressed fear and trauma over the upcoming execution.
