Blackburn Issues ‘Container Act’ Giving States Power to Secure Border

Sen. Marsha Blackburn’s “CONTAINER Act” proposes to grant border states the authority to independently secure the US-Mexico border without federal approval.

The act would enable states to place temporary structures such as razor wire and shipping containers along the border, invoking the Constitution’s “invasion clause.”

“Since President Biden took office, there have been over 8.5 million apprehensions at our southern border, turning every state into a border state,” Blackburn said.

“Meanwhile, his administration has only exacerbated the problem by trying to stop the use of measures that will secure our border like shipping containers and razor wire,” Blackburn added.

“Because Joe Biden refuses to do so, it’s clear Congress must act to give border states the explicit authority to protect their communities and the sovereignty of the United States.”

The legislation aims to address the administration’s alleged failure to secure the border, as federal agencies have intervened to remove state-placed barriers.
