The United States district judge overseeing Donald Trump’s Mar-a-Lago case has ordered the unsealing of documents, despite concerns from Special Counsel Jack Smith about disclosing classified information.
Smith sought permission to file motions under seal and to exceed page limits due to sensitive classified information.
The judge found insufficient evidence to support these requests and emphasized the presumption against ex parte filings in the adversarial system of justice. (Trending: First Moon Mission In 50 Years Blasts Off)
“Although the Special Counsel suggests that the mere filing of its motion for additional pages might ‘reveal the contours and extent of the Government’s CIPA Section 4 motion,’ because it indicates that ‘four categories of especially sensitive classified information’ will be addressed in the Section 4 motion, that bare reference, without more, is not a basis to deviate from the presumption against ex parte filings in our adversarial system of justice,” the judge wrote.

In a subsequent update, Smith clarified that the special counsel had not opposed the public release of most filings.
Additionally, Trump’s lawyer and spokeswoman warned Smith about the cases against her client after a U.S. Supreme Court ruling.
“This is a due process violation,” Alina Habba stated, claiming that Smith is “running scared.”
