Texas counties have declared the border crisis an “invasion” and are now invoking constitutional powers in order to address illegal immigration issues.

The Biden administration’s actions, such as challenging Texas laws on immigration and opposing border barriers, have fueled Republican criticism regarding Biden’s poor handling of the border.

“The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence,” Article IV, Section 4 reads. “The latest to do so are the judges and commissioners of Bandera, Schleicher and Uvalde counties,” The Center Square wrote.

”Officials in Bandera and Schleicher counties signed nearly identical resolutions in November as Crockett County’s. Crockett County declared an invasion after its county judge’s family members were killed by an alleged human smuggler. Uvalde County officials signed their invasion resolution in July, when they also joined a coalition led by Atascosa County Judge Weston Cude.”

“The invasion is unsustainable and threatens the lives of our citizens,” they added.

“The Biden administration created the border crisis, county officials argue, with an estimated 10 million people illegally entering the country since 2021. An unprecedented 1.9 million illegal entered Texas in fiscal 2023 alone.”

“Its efforts, through SB 4, intrude on the federal government’s exclusive authority to regulate the entry and removal of noncitizens, frustrate the United States’ immigration operations and proceedings, and interfere with U.S. foreign relations. SB 4 is invalid and must be enjoined,” DOJ lawyers wrote.

“House Republicans are now holding American families hostage alongside the critical funding our allies desperately need by threatening to shut down the government to pass extreme immigration policies,” Rep. Nanette Barragan said.

The struggle between Texas officials taking action against illegal immigrants and the federal government’s response looks to remain a pressing political issue in 2024.
