Trump Defense Strategy In January 6 Case May Go Beyond Trying To Delay Trial, Court Filings Reveal

Donald Trump’s legal strategy in his federal 2020 election interference case involves attempts to delay the trial, absolve himself of responsibility for the Capitol attack, and position himself as a victim of disinformation.

His team aims to point to biased individuals in the government, foreign influence, and election disinformation as reasons for his belief that the election was stolen.

Trump’s team also wants to highlight potential political bias among investigative agencies and witnesses.

Prosecutors “cannot blame President Trump for public discord and distrust of the 2020 election results while refusing to turn over evidence that foreign actors stoked the very same flames,” Trump’s attorneys wrote.

“Evidence of covert foreign disinformation campaigns relating to the 2020 election supports the defense argument that President Trump and others acted in good faith even if certain reports were ultimately determined to be inaccurate.”

“Based on public statements from attorneys on behalf of the USAO-DC that are inconsistent with the Special Counsel’s theory of January 6, it is a virtual certainty that there are similar nonpublic documents and private communications relating to this issue,” Trump’s team wrote.

However, prosecutors are aiming to eliminate these defenses before the trial, arguing that they are irrelevant and not connected to the charges.

“The Court should not permit the defendant to turn the courtroom into a forum in which he propagates irrelevant disinformation, and should reject his attempt to inject politics into this proceeding,” the prosecutors wrote.

“Evidence is not relevant upon a party’s mere say-so; it must be connected to the charges in the indictment or to a legitimate defense supported by sufficient evidence.”

Trump’s trial is scheduled for March, but potential delays are expected due to ongoing appeals, including arguments about presidential immunity and a gag order.
