The Biden administration is planning to sue Texas over a new state law that criminalizes illegal entry into the state, claiming it interferes with federal immigration law.
The law, approved by Governor Abbott, allows local police to enforce immigration and deport those who cross into Texas back to Mexico.
The DOJ has threatened legal action, arguing that only the federal government should handle the removal of foreign nationals. (Trending: Melania Trump Announces Big Change For 2024)
“The Department of Justice intends to bring a lawsuit to enforce the supremacy of federal law and to enjoin the operation of SB 4,” Brian M. Boynton of the DOJ wrote to Abbott.
“The United States will pursue all appropriate legal remedies to ensure that Texas does not interfere with the functions of the federal government.”
“Indeed, the Supreme Court has confirmed that ‘the removal process’ must be ‘entrusted to the discretion of the Federal Government’ because a ‘decision on removability’ touches ‘on foreign relations and must be made with one voice,’” the letter added.
Texas is prepared to fight the lawsuit, citing the need to protect its citizens from the impact of open border policies.
“Texas is prepared to take this fight all the way to the U.S. Supreme Court to protect Texans and Americans from President Biden’s open border policies. President Biden’s deliberate and dangerous inaction at our southern border has left Texas to fend for itself,” Abbott spokeswoman Renae Eze said.
Additionally, the law is facing challenges from liberal legal groups, while illegal crossings continue to rise.
