Apple is appealing a US sales ban of its smartwatches, imposed by the US International Trade Commission over a patent dispute with medical technology maker Masimo Corp.
The ban affects the Series 9 and Ultra 2 models, and Apple has submitted a software update it believes will mitigate the issue.
The ban includes a sales prohibition at Apple’s retail channels and a halt on importing the devices into the US. (Trending: Trump Releases Must-See TV Ad Ahead of 2024)
The company’s holiday season results are unlikely to be significantly impacted, and investors have reacted calmly to the situation.
The Office of the US Trade Representative, said, “After careful consultations, Ambassador Tai decided not to reverse the ITC’s determination and the ITC’s decision became final on December 26, 2023.”
Masimo has alleged that Apple violated its health technology patents and stole trade secrets, while Apple has countersued, alleging similar actions by Masimo.
The White House has declined to overturn the ban, and the two companies have not reached a settlement.
