A New York federal appeals court ruled that Douglass Mackey, convicted of conspiracy for posting allegedly fraudulent pictures about the Hillary Clinton campaign in the 2016 presidential election, can delay his custody term as he appeals his case.
The court granted his motion for release pending appeal, citing “substantial” legal issues in his case.

The case made national headlines, with conservative commentators alleging the DOJ targeted him because of his support for President Trump, while prosecutors maintained that he “weaponized disinformation” to interfere with voter participation.
“I am gratified by today’s ruling and look forward to the Second Circuit’s resolution of the important questions presented by my appeal,” said Mr. Mackey in a statement.
Prosecutors in this case have maintained that they charged Mr. Mackey because he “weaponized disinformation in a dangerous scheme to stop targeted groups, including black and brown people and women, from participating in our democracy.”
