Steve Bannon, a longtime ally of former President Donald Trump, has appealed his conviction for defying a subpoena from the House committee investigating the Jan. 6 Capitol incursion.

Bannon’s attorney argued that he was attempting to avoid running afoul of executive privilege objections raised by Trump, while prosecutors stated that Bannon deliberately chose not to comply with the lawful congressional subpoena.

Bannon was convicted of contempt of Congress and sentenced to four months in prison, though the sentence was put on hold pending his appeal. (Trending: Donald Trump Gets Great News)

“Mr. Bannon acted in the only way he understood from his lawyer that he was permitted to behave,” attorney David Schoen said, adding that Bannon was wrongly blocked from making that argument at trial.

“Stephen Bannon deliberately chose not to comply in any way with lawful congressional subpoena,” argued prosecutor Elizabeth Danello.

Additionally, Bannon is set to go on trial in May on separate money laundering, fraud, and conspiracy charges related to the “We Build the Wall” campaign.
